DECLARATION OF TRUST

THE SIR THOMAS J. LIPTON

CHALLENGE TROPHY 1913/1980

(Amended February 17, 1992, November 15, 1993 and January 17, 2005)

WITNESSETH: That it is hereby declared as follows

FIRST: The SIR THOMAS J. LIPTON CHALLENGE TROPHY 1980 is a sterling silver sloop, 14 lbs., 2 oz. sterling weight, 21" loa, 31" tall with mainsail, jib foresail and top foresail on a black lacquered base and mounted on a 33" x 28" x 6" two-tier walnut base with Lucite cover.

SECOND: This trophy shall be known as “THE SIR THOMAS J. LIPTON CHALLENGE TROPHY (1913)". The undersigned and its successors, whether an association or corporation, shall act as its trustee. The trophy may, at the discretion of the undersigned, be displayed in the San Francisco Maritime Museum, or in such other suitable public location. When awarded to a club, it may remain in the possession of that club until such time as the undersigned has designated for its return. At that time it must be delivered to an officer or proper representative of the undersigned. Each yacht club winning the privilege of holding the trophy shall undertake its safe custody while entitled to possession and shall guarantee its return in good condition.

THIRD: This trophy shall be awarded to the winner of a race or race series between sailing yachts belonging to members of clubs belonging to the undersigned. Said yachts, no more than one to each club, shall have belonged to or been chartered by a club member 30 (thirty) days prior to the race, The helmsperson and tactician of each yacht shall be properly enrolled members of the sponsoring club under its customary membership procedure; however, the other members of the crew do not need to be members of the sponsoring club. The primary purpose of such enrollment shall have been other than participation in this contest. In the event a yacht is chartered, the owner or his representative may be on board, but shall act only as observer. The race shall be conducted in accordance with the following conditions:

1.          Races for this cup shall be under the jurisdiction of a Regatta Chair appointed by the Pacific Inter-Club Yacht Association Board of Directors. The Principal Race Officer shall be selected by the Regatta Chair. The Race Committee shall be selected by the Regatta Chair, and all members shall be from PICYA member clubs. The decisions of the Regatta Chair shall be final, except for appeals from decisions on protest or request for redress.

2.          No more than one race or race series shall be conducted in a calendar year. It shall be held on San Francisco Bay at a time between June 1st and September 30th. The location and date will be set by the Regatta Chair of the undersigned.  In the event of cancellation, postponement or abandonment of the race series, it can be rescheduled by the Regatta Chair provided it can be done by September 30.

1.          To participate, the entering yacht must have a current rating certificate of a handicapping system designated by the Regatta Chair. The designated class or rating system, and the rating limits under that system for yachts racing, shall be declared by the Regatta Chair not later than the March meeting of the delegates of PICYA.

2.          A Notice of Race and entry forms will be sent by the PICYA Regatta Committee to member clubs. The yacht name and helmsperson are to be declared on the entry form, and a copy of the current rating certificate is required prior to the race. List of crew must be supplied to the Race Committee prior to the race.

FOURTH: This declaration of trust may be amended by the Board of Directors of PICYA.
